Attorney General Consultation – Nassau, Bahamas – In line with the Government objectives outlined in the 2023 Speech from the Throne, the Government is pleased to announce the launch of a public consultation on legal reforms to improve the protection of intellectual property in the Bahamas.

In our Plan for Change, we recognized that a key component of our economy requires the creation of a new economic model for creators and the orange economy in the Bahamas. Equally, we recognize that we need to provide a legal and practical framework that will empower creators to negotiate contracts with international distribution platforms, encouraging creators to obtain intellectual property protection for their creations.

Our government has comprehensively reviewed the Bahamas’ intellectual property laws and will implement new legislation that is consistent with current international best practices and will facilitate an effective and orderly process for the international and domestic protection of intellectual property assets and creations. Legislation and regulations will provide protection for copyrights, geographical indications, integrated circuits, patents, trademarks and new plant varieties. The new legal framework is the subject of this public consultation.

To achieve our goals of using intellectual property, it must be easy for creators to protect their assets, creations, and inventions. We will reform the process for obtaining intellectual property protections and, in line with international best practices, a separate Intellectual Property Office headed by an Intellectual Property Registrar within the Attorney General and the Ministry of Legal Affairs will be proposed. This dedicated Intellectual Property Office aims to provide much-needed focus and attention to intellectual property in the Bahamas.

Under the new reforms, it is proposed that The Bahamas join various international intellectual property agreements and expand international protection of Bahamian intellectual property rights. An overview of these international agreements is contained in the consultation documents.

The public is invited to visit the public participation website at ipbahamas.gov.bs to review the various bills and other information regarding proposed changes to the framework for protecting Bahamian Intellectual Property. Suggestions and comments will be welcomed until midnight on 15 March 2024, after which all feedback will be compiled and carefully considered together with draft bills.

The final version of the bills is planned to be submitted to the Parliament in the second quarter of 2024.
